Terms of Service

1. Who we are

Echo is provided by Bright Peak GmbH, Kürnbergstraße 32a, 81369 München, Germany (Handelsregister HRB 286591 — see our Impressum for full details), ("Bright Peak", "we", "us"). These Terms govern your use of the Echo desktop application ("Echo", the "App") and the backend services that support it (together, the "Service").

2. What Echo does

Echo is a desktop application for Windows that, on a keyboard shortcut you press, reads the message currently visible on your screen (for example an email, chat, or text message) and drafts a reply in a tone of voice you configure. Echo pastes the draft into the currently focused text field. Echo never sends anything on its own. Reviewing and sending — or not sending — any drafted reply is always your decision.

To draft a reply, Echo may capture a screenshot of the active application window (Modes A/B) or, for saved templates, only the text you provide (Mode C). This content is sent to our backend, which forwards it to Anthropic's Claude API to generate the draft. See our Privacy Policy for how this data is handled.

Optionally, you can connect your Gmail account to allow Echo to read your Sent folder and automatically generate a personalized writing-style profile from your past emails. This feature requires your explicit consent and can be disconnected at any time from within the App. See our Privacy Policy for full details on how Gmail data is used.

3. Accounts

You need an account to use Echo. You can sign in with a one-time code sent to your email address, or via Google Sign-In. You're responsible for keeping access to your sign-in method secure. We may suspend or terminate an account we reasonably believe is being used to abuse the Service (for example, to circumvent usage limits or to process content that violates these Terms or applicable law).

4. Plans, billing & cancellation

Echo offers three plans:

• Free — 30 drafted replies per month, at no charge.
• Echo Plus — 250 drafted replies per month at $14.99/month.
• Echo Pro — unlimited drafted replies at $49.99/month.

All plans include every feature — tone profiles, templates, signatures, all three reply modes. Plans differ only in monthly reply volume. Paid subscriptions are billed monthly in advance via Stripe, our payment processor. Prices are shown in the App and on our website and may change with notice.

• You can cancel a paid subscription at any time from inside the App (Settings → Account → Manage subscription). Cancellation takes effect at the end of the current billing period — you keep access until then, and we don't provide prorated refunds for partial periods, except where required by law (see the right of withdrawal below).
• Switching between Echo Plus and Echo Pro is handled via the Stripe Customer Portal, which applies standard proration.
• We don't store your card details — Stripe handles payment collection directly.

Right of withdrawal (EU and UK consumers)

If you are a consumer habitually resident in the EU or UK, you have a statutory right to withdraw from a distance contract within 14 days of conclusion without giving any reason (EU: § 355 BGB / Art. 9 Directive 2011/83/EU; UK: reg. 29 Consumer Contracts Regulations 2013).

Because Echo is a subscription service that you can begin using immediately, we will ask you at checkout — before payment is completed — to (a) expressly request that performance of the service begins before the end of the 14-day withdrawal period, and (b) acknowledge that, if you later withdraw, you will owe us a proportionate amount for the service actually provided up to that point (§ 357 Abs. 8 BGB; reg. 36 Consumer Contracts Regulations 2013). That acknowledgement must be given actively; it cannot be pre-ticked.

If you exercise the right of withdrawal, we will refund all amounts paid, less the pro-rata value of the service received up to the date of withdrawal. UK subscribers should note that the rules around auto-renewing subscription contracts are subject to ongoing regulatory development (Digital Markets, Competition and Consumers Act 2024); we will update these Terms as relevant provisions come into force.

5. Acceptable use

You agree not to use Echo to:

• Draft or send content that is unlawful, harassing, fraudulent, or infringes someone else's rights;
• Attempt to circumvent usage limits, reverse-engineer the Service, or access it through means other than the App and its intended hotkeys;
• Use the Service to process another person's sensitive personal data without a lawful basis for doing so.

6. Your content

You retain all rights to the messages, screenshots, and drafts processed through Echo. We use that content only to provide the Service to you (drafting replies, enforcing usage limits) — not to train AI models, and not to share with third parties beyond the sub-processors described in our Privacy Policy.

7. Availability

Echo is in active development. Features, hotkeys, and pricing may change, and the Service may occasionally be unavailable for maintenance or due to issues with third-party providers (Anthropic, Stripe, Supabase, Google) that Echo depends on. We'll try to give notice of material changes where practical.

8. Disclaimers & liability

Echo drafts replies using AI — drafts can be inaccurate, incomplete, or simply not what you meant to say. You are responsible for reviewing every draft before sending it. The Service is provided without warranties of any kind beyond those required by mandatory law.

Liability of Bright Peak GmbH for damages is governed as follows:

1. Unlimited liability. We are fully liable, without monetary limit, for: (a) damages arising from injury to life, body, or health, including where caused by simple negligence; (b) damages caused by our own intent or gross negligence, or that of our legal representatives or vicarious agents; (c) liability under the German Product Liability Act (Produkthaftungsgesetz); (d) liability arising from an express guarantee we have given; and (e) damages resulting from defects we have fraudulently concealed.
2. Limited liability for simple negligence — essential duties only. Where we breach an essential contractual duty (a duty whose proper performance is a prerequisite for the contract being carried out at all, and on whose observance you may regularly rely — Kardinalpflicht) through simple negligence, our liability is limited to the foreseeable damage that is typical for this type of contract.
3. Exclusion otherwise. Any further liability of Bright Peak GmbH for damages caused by simple negligence is excluded.

These limitations apply equally to our legal representatives and vicarious agents.

9. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you (for example, in the App or by email) before they take effect.

10. Governing law

These Terms are governed by the laws of Germany, without regard to conflict-of-law rules. If you are a consumer habitually resident in another EU member state, mandatory consumer protections of that state may also apply.
